Democratic Congress Targets Nvidia Chip Exports, Circular Financing

A new Democratic majority plans subpoenas and investigations into Nvidia's chip export practices and circular financing, with Sen.

Nvidia Corp. faces heightened congressional scrutiny after Democrats won control of both chambers of Congress on November 3, with planned investigations into the chipmaker's AI chip exports and circular financing practices1,3.

Nvidia stock fell on November 6 as the prospect of congressional AI regulation and export control probes weighed on shares2.

Warren's Banking Committee gavel

Sen. Elizabeth Warren of Massachusetts is expected to chair the Senate Banking Committee when Democrats take over in January, according to the Wall Street Journal5. The committee oversees the Federal Reserve, banks, securities markets, and increasingly digital assets. Warren called for a pause in artificial intelligence development in September and joined efforts to establish a new federal agency to regulate big tech and AI6.

Democrats are expected to start with subpoenas and investigations, according to the Washington Sun. The cryptocurrency and artificial intelligence industries are described as major drivers of the data-center surge that voters rebelled against in the midterm elections. Crypto groups spent $180 million while AI-affiliated groups spent over $72 million, both primarily for Republicans, in the 2026 cycle.

Limits of legislative power

Democrats will hold 54 seats in the upper chamber and could land two more, but their majorities are not filibuster- or veto-proof4. A purely partisan attempt at regulation is expected to fail with a Republican president who has boosted both the AI and crypto industries. Morgan Stanley analysts wrote that policy uncertainty since the beginning of President Trump's second term has been tied to executive, not legislative, action, and that policies on tariffs, geopolitics, trade deregulation, and export controls are all likely to persist.

ANALYSIS The Democratic majority's clearest near-term lever over Nvidia is investigative rather than legislative: subpoena power and public hearings can force disclosure on chip export practices and financing arrangements even without new law.

Successful Democratic candidates ran on platforms stressing affordability, guardrails on AI data centers and development, and accountability for businesses and politicians. Rep. Robert Garcia has said Oversight probes into Trump family deals could start as early as February 2027.

Democrats' first actions are expected to be bipartisan and heavily influenced by Warren.
